Terms and Conditions of Sale

1. Seller identification
The lera-concept.com website is operated by LERA CONCEPT, SARL with share capital of MAD [●], whose registered office is at Immeuble Zénith Business Center, rue Mouslim, 40000 Marrakech.

Hereinafter “Lera Concept”.
2. Purpose and scope
These terms govern the sale by Lera Concept of the following services: showcase website creation, hosting and domain name, maintenance, and the All-Inclusive Plan. They apply to business and private clients alike.
They can be viewed at any time from every page of the website. The applicable terms are those in force on the date of the order.
3. Offers and prices
All prices are in dirhams, all taxes included (VAT 20 %).
3.1 Showcase website
MAD 2,999 incl. VAT, as a one-off payment. The website includes:
- up to 30 pages, including a blog, an FAQ, a contact form and the legal pages;
- a custom design, responsive on mobile and tablet;
- SEO optimization of every page;
- a WhatsApp button;
- a second language;
- setting up the Google Business Profile.
3.2 Monthly options, no commitment
- Hosting and domain name (.ma or .com), SSL, backups and monitoring: MAD 129/month, or MAD 1,290/year.
- Maintenance (updates, security, small content changes): MAD 299/month, or MAD 2,990/year.
On the annual plan, 10 months are billed out of 12.
3.3 All-Inclusive Plan
MAD 399 incl. VAT/month, with no setup fee, on a 12-month commitment. The plan includes:
- the showcase website described in article 3.1;
- hosting and the domain name;
- maintenance;
- one SEO-optimized blog article per month;
- the creation of extra pages throughout the subscription.
Its specific terms are set out in article 10.
3.4 Services outside the scope
An online shop, custom development, a photo shoot, long-form copywriting or an additional language are covered by a separate quote, accepted before work begins.
4. Orders
Orders are placed online. The client enters their contact details and status (business or individual), then chooses a plan. Before confirming, they see the breakdown and the total price of their order and can correct their information (Article 65-5 of the Moroccan Code of Obligations and Contracts (DOC)).
The client expressly accepts these terms by ticking the box provided for that purpose (Article 30 of Law No. 31-08). If they choose the All-Inclusive Plan, they also tick a separate box accepting the 12-month commitment.
The order is concluded on confirmation. Lera Concept acknowledges receipt by e-mail, with a summary and a link to the version of the terms accepted. Lera Concept keeps these records and provides them to the client on request.
5. Payment and invoicing
Payment is made exclusively online, by bank card on the CMI secure platform, or via Lana Cash. Lera Concept never has access to the client’s bank details.
Payments are due as follows:
- Build : the price is paid when you order. If the client keeps options, their first instalment is paid at the same time.
- Options and All-Inclusive Plan : the following instalments are charged automatically to the card, on each anniversary date.
An invoice is issued for every payment. For a business client it states the company name and ICE number, which the client provides with the brief.
6. Lead times and delivery
After the order, the client receives a guided brief form. The 5-business-day delivery time runs from the receipt of a complete brief (copy, visuals, information and any access required). Any missing item suspends this deadline. The client is informed the same day of any difficulty likely to delay delivery.
For a consumer client who has not requested the early start provided for in article 12, the deadline only starts once the withdrawal period has ended.
If the client does not reply for more than 60 days to a request for information or approval, the project may be considered abandoned. Sums already paid then remain with Lera Concept for the work carried out. For the All-Inclusive Plan, the monthly payments remain due under the conditions of article 10.
7. Content supplied by the client
The client provides the text, logos, photographs and information intended for their site. They warrant that they are the author or hold the necessary permissions (Law No. 2-00 on copyright and related rights), and warrant that this content is accurate and lawful. They indemnify Lera Concept against any third-party claim relating to this content.
At the client’s request, Lera Concept can write copy or suggest freely licensed images. These items are supplied with their usage rights for the website.
8. Approval and delivery
The site is presented to the client before going live. Adjustments requested during this review are included, within the scope of article 3. The website goes live after the client’s written approval; an e-mail or a WhatsApp message is enough.
If the client does not respond within 30 days of the handover, Lera Concept follows up in writing. With no reply eight days after that follow-up, the build is deemed delivered.
Requests made after the site goes live fall under maintenance or an additional quote.
9. Hosting and maintenance (outside the All-Inclusive Plan)
The hosting and maintenance options have no minimum term. They can be cancelled at any time by a simple written request to contact@lera-concept.com. Cancellation takes effect at the end of the current period; the annual plan is not refunded pro rata.
Without maintenance, the website is no longer updated, backed up or monitored by Lera Concept.
On termination, Lera Concept hands the website files and the access details over to the client, and assists with transferring the site and the domain name to the provider of their choice.
10. All-Inclusive Plan
10.1 Term. The plan is taken out for a firm term of 12 months from confirmation of the order. At the end of that term, it continues month by month, with no commitment, at [MAD 399 / MAD 428] incl. VAT per month. It can then be cancelled under the conditions of article 9.
10.2 Client information. Lera Concept informs the client in writing of the end of their commitment period, at least 30 days before it ends.
10.3 Early termination. If the client cancels before the end of the 12 months, except for a legitimate reason (documented closure of business, force majeure), part of the monthly payments remaining until the end of the term becomes payable:
- for a business client, the full amount;
- for a consumer client, 50 %.
10.4 Unpaid instalments. If a direct debit fails, Lera Concept informs the client in writing. Without settlement within 15 days, hosting and maintenance may be suspended. Suspension does not extend the commitment period and gives rise to no compensation. Restoration is subject to payment of the amounts due.
11. Ownership and references
Once paid in full, the client owns the delivered website, its content and its domain name. For the All-Inclusive Plan, payment in full means the payment of the 12 monthly instalments of the commitment period, or of the balance due under article 10.3. Until that payment, Lera Concept retains ownership of the website.
Lera Concept keeps ownership of its tools, methods, reusable components and generic developments. Third-party licences remain subject to their own terms.
Unless the client objects in writing, Lera Concept may feature the website in its work, with the client’s name and screenshots.
12. Right of withdrawal (consumer clients)
A client ordering as a consumer, within the meaning of Article 2 of Law No. 31-08, has a period of seven days from confirmation of the order to withdraw, with no reason to give and no penalty (article 36). This right is exercised by e-mail at contact@lera-concept.com. The sums paid, including the first monthly instalment of the All-Inclusive Plan, are refunded within fifteen days (article 37).
Under Article 38, this right can no longer be exercised once work on the website has begun before the end of that period with the client's agreement. This agreement is obtained at the time of the order, through a separate and optional checkbox.
Business clients do not have this right.
13. Liability
Lera Concept is bound by an obligation of means. The SEO included covers the technical and editorial optimization of the pages; no ranking in Google is guaranteed.
Lera Concept is not liable for:
- content supplied by the client;
- interruptions or malfunctions attributable to third parties (internet provider, domain name registry, integrated external services);
- cyberattacks not resulting from a failure on its part.
For a business client, its liability is limited to the sums paid for the service concerned over the last 12 months. It excludes indirect damages, except in case of wilful misconduct or gross negligence (article 232 of the DOC). For a consumer, these provisions apply without prejudice to their rights under Law No. 31-08.
14. Personal data
The data collected is used to fulfil the order, for invoicing and for managing the relationship. It is processed in accordance with Law No. 09-08 (CNDP declaration No. [●]). The client has a right of access, rectification and objection, set out in the privacy policy.
15. Force majeure
Neither party is liable for a failure caused by force majeure within the meaning of articles 268 and 269 of the Moroccan Code of Obligations and Contracts (DOC): natural disaster, fire, widespread network outage, major cyberattack, administrative decision, unforeseeable failure of an essential technical provider. Performance is suspended for the duration of the event.
16. Changes to the terms
Lera Concept may amend these terms and its prices. Orders remain governed by the version accepted. For ongoing subscriptions, any price increase is notified at least 30 days in advance; the client may then cancel free of charge, except during the All-Inclusive Plan commitment period, whose price is guaranteed.
17. Governing law and disputes
These terms are governed by Moroccan law. The parties shall seek an amicable solution before any action. Failing that, any dispute with a business client falls to the commercial courts of Marrakech. For a private individual, the statutory rules of jurisdiction apply.
